TERMS & CONDITIONS
PET CIRCLE RELOCATION SERVICES L.L.C
Last updated: 3 October 2026
These Terms & Conditions (“Terms”) govern all services provided by PET CIRCLE RELOCATION SERVICES L.L.C, trading under the brand “Petcircle” (“Petcircle”, “we”, “us” or “our”), a company registered in the United Arab Emirates.
For the purposes of these Terms:
- “Client” means the individual or legal entity purchasing, requesting or instructing the Services.
- “Pet” means the animal to which the Services relate.
- “Services” means the documentation, advisory, coordination and other services expressly agreed between Petcircle and the Client.
- “Competent Authority” means any government, veterinary, customs, border, agricultural, regulatory or other authority with jurisdiction over any part of the Pet’s journey.
Where a Client acts on behalf of a pet owner, traveller, company or other third party, the Client warrants that it has the necessary authority to provide the relevant information and to instruct Petcircle on that party’s behalf.
By accepting a quotation or booking confirmation, making any payment after these Terms have been made available to the Client, submitting documentation with instructions to proceed, or otherwise expressly instructing Petcircle to commence the Services, the Client agrees to be legally bound by these Terms.
1. SCOPE OF SERVICES
1.1 Petcircle provides professional pet travel documentation, regulatory coordination and related support services for international pet travel, relocation, import, export and transit.
Depending on the individual booking, our Services may include:
- import and export documentation;
- import and export permits;
- preparation and coordination of health certificates;
- review of vaccination records, microchip information, rabies antibody titre test results and parasite treatments;
- communication and coordination with veterinarians, official veterinarians, laboratories, government authorities, airlines, ground handlers, agents and other third parties;
- guidance regarding country-specific pet travel requirements;
- appointment and process coordination;
- document checks prior to travel;
- translations or multilingual support where agreed;
- pet travel and relocation support expressly included in the quotation; and
- where specifically requested, preliminary communication with the relevant authority regarding breed eligibility or other potential travel, import or export restrictions.
1.2 The exact scope of Services is limited to the Services expressly stated in the Client’s quotation, booking confirmation, invoice or other written agreement.
1.3 Unless expressly agreed otherwise in writing, Petcircle provides documentation, advisory and coordination services only. Petcircle is not an airline, air carrier, veterinarian, laboratory, customs authority, government authority, border authority or regulatory body.
1.4 Petcircle does not itself issue government approvals, veterinary certifications or regulatory decisions unless Petcircle is legally authorised to do so.
1.5 Any Services not expressly included in the agreed scope are excluded and may be subject to additional fees.
1.6 Petcircle’s obligations are limited to performing the agreed Services with reasonable professional care and skill. The provision of the Services does not constitute a guarantee of a particular regulatory, veterinary, airline or travel outcome.
2. ACCEPTANCE AND COMMENCEMENT OF SERVICES
2.1 A binding agreement is created upon the earliest of:
- written acceptance of our quotation or booking confirmation after these Terms have been made available to the Client;
- payment of any invoice or deposit following receipt of the applicable contractual terms;
- written instruction to commence work following receipt of the applicable contractual terms; or
- submission of documents accompanied by an instruction to proceed following receipt of the applicable contractual terms.
2.2 Once Petcircle begins reviewing documents, contacting third parties, preparing applications, providing route-specific regulatory guidance or otherwise carrying out substantive work, the Services shall be deemed to have commenced.
2.3 Where mandatory consumer protection legislation requires additional formalities for the formation of a contract, such requirements shall prevail.
3. CLIENT INFORMATION AND RESPONSIBILITIES
3.1 The Client bears primary responsibility for providing complete, accurate and timely information.
The Client must provide all information requested by Petcircle, including where applicable:
- correct legal name of the owner or authorised traveller;
- passport and identification details;
- correct travel dates and routing;
- departure, transit and destination countries;
- pet species, breed, sex, age and weight;
- complete microchip number;
- pet passport and vaccination records;
- rabies vaccination information;
- rabies antibody titre test results;
- veterinary records;
- parasite treatment details;
- addresses at origin and destination;
- ownership information;
- airline or flight information;
- the Pet’s exact breed and, where applicable, all known breed components of a mixed breed; and
- any other information relevant to the Pet’s legal eligibility to travel.
3.2 The Client must ensure that the Pet’s breed is accurately identified in the relevant veterinary records, pet passport, health certificate and other official documentation.
3.3 Where the Pet is a mixed breed, the Client must disclose all known breed components. The Client must not describe a mixed-breed Pet as a non-restricted breed merely because the Pet resembles another breed or because a particular breed description would be more convenient for travel purposes.
3.4 The Client warrants that all information and documents supplied are genuine, accurate, complete and current.
3.5 The Client further warrants that the Pet is lawfully owned, possessed or transported by the relevant owner or authorised person and that all necessary permissions to arrange the Pet’s travel and documentation have been obtained.
3.6 Petcircle shall not be responsible for consequences resulting from inaccurate, incomplete, misleading, outdated or late information supplied by the Client or any person acting on the Client’s behalf, including incorrect or incomplete breed information, except to the extent that a loss results from Petcircle’s own breach of its contractual or statutory obligations.
3.7 The Client must promptly inform Petcircle of any change affecting the Pet, the owner, the planned journey or any information previously provided.
4. PET ELIGIBILITY, BANNED BREEDS AND LEGAL COMPLIANCE
4.1 The Client remains responsible for ensuring that the Pet is legally and medically eligible to travel and complies with the applicable requirements of every country and authority involved in the journey.
This includes compliance with requirements relating to:
- microchipping;
- vaccinations;
- rabies vaccination validity;
- rabies antibody titre testing;
- parasite treatments;
- waiting periods;
- veterinary examinations;
- breed restrictions;
- banned breeds;
- restricted breeds;
- mixed breeds or crossbreeds;
- age restrictions;
- ownership requirements;
- animal welfare requirements;
- import or export restrictions;
- quarantine;
- CITES or other wildlife requirements; and
- airline-specific acceptance requirements.
For the purposes of these Terms, this includes any breed, crossbreed or hybrid prohibited, restricted or subject to additional requirements under the applicable laws, regulations or current rules of any country of origin, transit or destination, or by any competent authority, airline or other relevant party involved in the Pet’s journey.
4.2 The Client must immediately notify Petcircle if the Pet is, or may be, a banned, restricted or mixed breed, or if the Pet’s breed identification is uncertain.
4.3 The Client must provide the exact breed information known to them and must ensure that the breed stated in the Pet’s passport, veterinary records, health certificate and other official documents is accurate and consistent.
4.4 Where the breed or breed composition is uncertain, disputed or potentially relevant to an import, export or travel restriction, Petcircle may require the Client to obtain additional supporting evidence, including a veterinary breed assessment, official breed statement or, where considered appropriate, a DNA breed report.
Any such evidence is provided for assessment purposes only. Petcircle does not represent or guarantee that a DNA breed report, veterinary statement or other supporting evidence will be accepted, relied upon or given any particular evidentiary weight by any competent authority, airline or other third party.
4.5 Where the Pet’s breed or breed composition may fall within a banned or restricted category, Petcircle may, at the Client’s request and subject to availability, contact the relevant authority in advance for preliminary guidance.
Any such communication is provided for assistance only and does not constitute approval, clearance or a guarantee that the Pet will be permitted to travel.
4.6 Where a Pet’s breed, breed composition or other characteristic may be subject to a prohibition or restriction, the competent authority may require additional information, supporting evidence or documentation before confirming the Pet’s eligibility for travel, import, export, transit or entry.
The nature and timing of any such review are determined solely by the relevant competent authority and may occur at any stage of the export, import, transit, entry or release process.
Any preliminary indication, informal guidance, previous experience, advice from an airline or veterinarian, issuance of any permit or preliminary communication with an authority does not constitute a guarantee of final approval, acceptance, transport, entry or release of the Pet.
4.7 The final decision regarding the Pet’s eligibility for export, import, transit, transport, entry or release remains solely with the relevant competent authority, airline or other authorised decision-maker, as applicable.
Petcircle has no authority to bind any such party or to guarantee that the Pet will ultimately be accepted or permitted to travel.
4.8 If a competent authority, airline or other authorised decision-maker determines that the Pet may not lawfully travel, be exported, imported, transited, transported or entered into the relevant country, the Client must not present or permit the Pet to travel contrary to that decision.
The Client is responsible for ensuring that the Pet does not commence or continue the journey where any legally required approval has not been obtained or has been refused.
4.9 The Client acknowledges that final regulatory or airline decisions may occur shortly before departure, after a flight has become non-refundable or after other travel arrangements have been made.
Where travel is prevented, delayed or refused due to circumstances for which Petcircle is not legally responsible, the Client remains responsible for the resulting costs, including where applicable:
- airline cancellation or change fees;
- unused flight costs;
- charter or aircraft costs;
- rebooking costs;
- ground transportation;
- boarding or accommodation;
- veterinary costs;
- quarantine or holding costs;
- customs or handling charges;
- storage costs;
- return transportation;
- additional documentation;
- additional health certificates;
- additional permits; and
- other reasonable costs arising from the refusal, delay or inability to transport the Pet.
Such costs remain subject to the terms of the relevant third-party contracts and any applicable mandatory consumer rights.
4.10 Petcircle is not responsible for these costs merely because a competent authority’s final decision was issued shortly before departure or after a flight could no longer be cancelled without cost, provided that Petcircle performed the agreed Services with reasonable professional care and skill.
4.11 Petcircle’s responsibility is limited to providing the agreed documentation, advisory and coordination Services with reasonable professional care and skill.
Petcircle is not responsible for obtaining a positive decision, approval, permit, clearance or acceptance from any competent authority, airline or other third party.
4.12 The Client must immediately notify Petcircle of any medical condition, change in vaccination status, change of owner, change of travel date, change of route, change of airline or other circumstance that may affect travel eligibility.
4.13 Unless expressly agreed otherwise, Petcircle’s Services relate to the non-commercial movement of privately owned pets.
The Client must inform Petcircle before booking if the movement may constitute a commercial movement, transfer of ownership, sale, adoption, rescue movement, breeder transaction or other regulated transaction.
Petcircle may decline Services that fall outside its licensed activities or its agreed scope of business.
5. REGULATORY ADVICE AND CHANGES IN REQUIREMENTS
5.1 Pet travel regulations are subject to change, sometimes without prior notice.
Any information or guidance provided by Petcircle is based on:
- the information supplied by the Client;
- the proposed itinerary;
- the breed and breed information supplied by the Client;
- the applicable rules reasonably known to Petcircle at the relevant time; and
- information available from competent authorities and industry sources.
5.2 Advice provided for one route, Pet, owner, date or airline must not be relied upon for another journey.
5.3 Petcircle may revise its instructions where government regulations, airline requirements, veterinary rules or other requirements change.
5.4 Any resulting additional work or third-party expense may be charged separately in accordance with Section 9.
5.5 Processing times, estimated approval dates and document delivery dates are estimates unless expressly confirmed as binding deadlines in writing.
6. NO GUARANTEE OF PERMIT, CERTIFICATE, BREED ACCEPTANCE OR ENTRY
6.1 Petcircle will use reasonable professional care and skill in performing the Services.
However, Petcircle does not and cannot guarantee:
- issuance of any import or export permit;
- issuance or endorsement of any health certificate;
- approval by an official veterinarian;
- acceptance of a banned, restricted or mixed-breed Pet;
- approval by any competent veterinary, governmental or regulatory authority, including MOCCAE where applicable;
- acceptance by any competent authority in any country of origin, transit or destination;
- acceptance by an airline;
- acceptance at check-in;
- permission for the Pet to board;
- customs or border clearance;
- entry into any country;
- release from customs or quarantine;
- exemption from quarantine;
- processing times of government authorities;
- availability of appointments;
- acceptance of any particular document by any competent authority, airline or other relevant third party; or
- successful completion of the Pet’s journey.
6.2 All final decisions remain with the relevant airline, veterinarian, laboratory, government authority, customs authority, border authority or other competent third party.
6.3 In particular, Petcircle does not guarantee that a Pet will be accepted where the Pet is a banned breed, restricted breed, mixed breed or suspected crossbreed.
Any final decision rests with the relevant competent authority or other authorised decision-maker after the review required by that party.
6.4 A rejection, delay or refusal by such a third party does not, by itself, constitute a failure by Petcircle to provide its Services where Petcircle has performed the agreed Services with reasonable professional care and skill.
7. CLIENT REVIEW OF DOCUMENTS
7.1 The Client is required to carefully review all draft or completed documents provided for review.
Particular attention must be paid to:
- names;
- passport numbers;
- microchip numbers;
- dates;
- vaccination information;
- travel dates;
- flight details;
- destination;
- Pet details;
- ownership details;
- breed;
- breed composition; and
- any description of the Pet’s physical characteristics.
7.2 Any suspected error must be reported immediately and, where no shorter deadline is stated by Petcircle, within 24 hours of receiving the document.
7.3 The Client must ensure that the breed and breed composition stated in the documents are accurate to the best of the Client’s knowledge.
7.4 Client approval of a document will be treated as confirmation that the information supplied by the Client and contained in that document has been reviewed and approved.
Such approval does not relieve Petcircle of its own obligations to perform the agreed Services with reasonable professional care and skill and does not prejudice any rights that cannot legally be excluded.
8. CLIENT DELAYS AND MISSED DEADLINES
8.1 Pet travel documentation frequently involves strict legal deadlines and waiting periods.
Where the Client fails to provide required information, disclose the Pet’s correct breed, provide requested breed-related supporting evidence, attend an appointment, complete a veterinary procedure or follow Petcircle’s instructions within the requested timeframe, Petcircle shall not be responsible for resulting consequences attributable to that failure, including:
- delays;
- missed flights;
- refusal to board;
- rejection;
- permit expiry;
- certificate expiry;
- additional appointments;
- repeat veterinary examinations;
- repeat laboratory tests;
- additional accommodation;
- boarding;
- transport;
- rebooking; or
- other resulting costs.
8.2 Any additional work required due to Client delay, inaccurate breed information or non-compliance may be charged separately in accordance with Section 9.
8.3 This Section does not exclude liability for losses caused by Petcircle’s own breach of its contractual or statutory obligations.
9. QUOTATIONS AND PRICES
9.1 Quotations are based exclusively on the information available at the time they are issued.
Unless otherwise stated in the quotation, quoted prices may exclude:
- government fees;
- veterinary fees;
- laboratory fees;
- DNA testing;
- official veterinarian fees;
- translation or legalisation fees;
- courier charges;
- airline fees;
- airport or handling fees;
- customs fees;
- quarantine fees;
- ground transportation;
- crates;
- taxes;
- duties; and
- other third-party expenses.
9.2 Third-party charges may change without notice.
9.3 The quoted price may be adjusted where additional costs arise as a direct result of changes in government fees, mandatory third-party charges, taxes, routing, travel dates, regulatory requirements, Client-requested changes, or inaccurate or incomplete information supplied by the Client.
Any adjustment must reasonably reflect the resulting additional cost and shall not be made solely at Petcircle’s discretion.
Where reasonably practicable, Petcircle will inform the Client before incurring any material additional cost.
9.4 The Client shall not be required to accept materially expanded Services outside the agreed scope without prior agreement, except where applicable law or the Client’s existing contractual obligations provide otherwise.
9.5 VAT shall be added where applicable.
10. PAYMENT
10.1 Unless otherwise agreed in writing, 100% payment is required before Petcircle commences the Services.
10.2 Petcircle may suspend or refuse to commence Services until all amounts due have been paid, subject to applicable law.
10.3 Any bank charges, payment gateway charges, currency conversion charges or similar transaction costs are borne by the Client unless expressly stated otherwise or prohibited by applicable law.
10.4 Where urgent or expedited Services are requested, Petcircle may charge an additional rush or out-of-hours fee, provided that the applicable fee has been disclosed and agreed before the additional Services are performed.
10.5 The Client must raise any genuine payment discrepancy or suspected billing error promptly so that it can be investigated.
Nothing in these Terms restricts the Client’s lawful rights to raise a payment dispute or seek a remedy under applicable law.
11. CANCELLATION AND REFUNDS
11.1 The Client acknowledges that Petcircle’s Services involve professional time, regulatory research, document preparation and third-party expenditure which may begin immediately after booking.
11.2 Before Services Have Commenced
If the Client cancels before Petcircle has commenced substantive work, amounts paid may be refunded less:
- payment processing charges;
- bank charges; and
- third-party costs already incurred.
Any deduction must be lawful, reasonable and supported by the applicable contractual terms.
11.3 After Services Have Commenced
Subject to any mandatory statutory cancellation, withdrawal or refund rights, once substantive Services have commenced, Petcircle’s professional fees relating to work already performed are earned and non-refundable.
Where document preparation, permit applications, authority communication, regulatory review, breed-related assessment or other substantive work has commenced, Petcircle may retain all or part of the Service Fee reflecting work already performed.
11.4 Third-Party Costs
Government fees, veterinary fees, laboratory charges, DNA testing, official veterinarian fees, courier charges, airline charges and other third-party expenses are non-refundable once incurred unless the relevant third party refunds those amounts or applicable law requires otherwise.
11.5 Regulatory Rejection or Breed Refusal
The refusal, rejection or delay of an application, permit, certificate, breed assessment, import, export, transit or entry by any competent authority does not automatically entitle the Client to a refund for Services already performed.
This applies in particular where the Pet is a banned breed, restricted breed, mixed breed or suspected crossbreed, or where the relevant authority determines that the Pet may not be imported, exported, transported, transited through or entered into the relevant country.
This Section does not exclude any refund or remedy available where Petcircle has failed to perform its contractual or statutory obligations.
11.6 Cancellation by Petcircle
If Petcircle cancels Services for reasons not caused by the Client and not resulting from circumstances outside Petcircle’s reasonable control, Petcircle will refund any Petcircle Service Fees paid for Services that have not yet been performed.
Petcircle shall not be required to refund third-party charges unless those amounts are recovered from the relevant third party or applicable law requires otherwise.
11.7 Mandatory Consumer Rights
Nothing in this Section limits any mandatory statutory cancellation, withdrawal, refund or other consumer rights.
12. CHANGES, RESCHEDULING AND RE-ISSUANCE
12.1 Changes to any of the following may require documents to be amended, replaced or reissued:
- owner;
- traveller;
- Pet;
- travel date;
- flight;
- airline;
- airport;
- route;
- destination;
- breed information; or
- regulatory status.
12.2 Any reissue, amendment or additional work may be charged separately, subject to Section 9 and applicable law.
12.3 Where an existing permit or certificate can no longer be used because of a Client-requested change, inaccurate information or a change in breed assessment, the Client is responsible for the reasonable cost of obtaining a replacement.
12.4 Where replacement is required because of an error attributable to Petcircle’s failure to perform the agreed Services with reasonable professional care and skill, the Client’s rights and remedies under applicable law remain unaffected.
13. THIRD-PARTY PROVIDERS
13.1 Petcircle may coordinate with independent third parties including:
- veterinarians;
- official veterinarians;
- laboratories;
- DNA testing laboratories;
- government authorities;
- airlines;
- aircraft operators;
- ground handlers;
- pet relocation agents;
- customs brokers;
- couriers;
- transportation providers; and
- other service providers.
13.2 Unless expressly stated otherwise, such third parties are independent entities and are not employees, subsidiaries or agents under the control of Petcircle.
13.3 Petcircle shall not be responsible for acts, omissions, delays, cancellations, errors, operational decisions or failures of independent third parties that are outside Petcircle’s reasonable control.
This does not exclude liability arising from Petcircle’s own breach of its contractual obligations or from any liability that cannot lawfully be excluded or limited.
13.4 Where appropriate, the third party’s own terms and conditions may apply in addition to these Terms.
13.5 Petcircle remains responsible for performing its own contractual obligations with reasonable professional care and skill, including the coordination Services expressly agreed with the Client.
14. AUTHORITY TO ACT
14.1 The Client authorises Petcircle to communicate with relevant authorities, veterinarians, airlines, laboratories, agents and other third parties and to submit information and documentation on the Client’s behalf where legally permitted and reasonably necessary to perform the Services.
14.2 This may include contacting MOCCAE, where applicable, or any other competent authority regarding the Pet’s breed, breed composition, documentation requirements or potential eligibility for import, export, transit or entry.
14.3 Any communication with an authority is made for coordination and information purposes only.
It does not give Petcircle authority to approve the Pet, guarantee any permit, approval, transport, export, import, transit, entry or release, or bind any authority or third party to any particular decision.
14.4 This authorisation does not permit Petcircle to make false declarations, veterinary certifications or legally restricted declarations on behalf of the Client.
14.5 Where an authority requires the Client, owner or veterinarian to sign, attend personally or make a declaration, the Client remains responsible for completing that requirement.
14.6 Where a separate power of attorney or other formal authorisation is legally required, the Client must provide it before Petcircle can undertake the relevant activity.
15. VETERINARY AND MEDICAL MATTERS
15.1 Petcircle does not provide veterinary advice and does not replace a qualified veterinarian.
15.2 Any information concerning vaccinations, parasite treatments, laboratory testing, DNA testing, fitness to travel or veterinary procedures is provided solely in the context of travel documentation and regulatory requirements.
15.3 The Client must obtain medical or veterinary advice directly from a qualified veterinarian where appropriate.
15.4 Petcircle is not responsible for any adverse medical reaction, illness, injury or other health consequence resulting from vaccination, medication, treatment, laboratory testing, DNA testing or travel itself, except to the extent that liability arises from Petcircle’s own breach of its obligations or cannot legally be excluded.
16. TRAVEL AND ANIMAL RISK
16.1 Travel may expose animals to inherent risks including stress, delays, temperature variation, unfamiliar environments, illness, injury and other events outside Petcircle’s control.
16.2 Unless expressly included in the Services, Petcircle does not take physical custody of the Pet and is not responsible for its physical transport or welfare during transportation.
16.3 The Client is responsible for assessing the suitability of travel for the Pet together with the Client’s veterinarian.
16.4 The Client must not present the Pet for transport or boarding where a legally required approval has not been obtained, has expired or has been refused, or where the Pet has otherwise been refused permission to travel.
16.5 Nothing in this Section excludes any responsibility that Petcircle expressly accepts under a separately agreed physical transport or animal-handling service, or any liability that cannot lawfully be excluded.
17. JETCIRCLE AND OTHER PARTNERS
17.1 Petcircle may work together with Jetcircle LLC and other commercial partners.
Unless expressly stated otherwise in writing:
- Petcircle and Jetcircle LLC remain separate contracting entities;
- pet documentation Services purchased from Petcircle are governed by these Terms;
- flight, charter, JetSharing or aviation Services purchased from Jetcircle LLC are governed by Jetcircle LLC’s separate contractual terms; and
- neither company assumes the contractual obligations of the other merely because the Services are coordinated.
17.2 Where a flight has been arranged through Jetcircle LLC or another aviation provider and the Pet is not permitted to board, travel, transit, be imported, exported or enter the relevant destination country, the Client remains responsible for all applicable flight, charter, cancellation, rebooking and related costs, subject to the separate terms governing the aviation Services and any mandatory applicable law.
17.3 Petcircle does not guarantee any flight operated, arranged or brokered by Jetcircle LLC or any other aviation provider.
17.4 Nothing in this Section excludes any liability that Petcircle expressly assumes under its own agreement with the Client or any rights arising under mandatory applicable law.
18. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL
18.1 Petcircle shall not be liable for delays, additional costs or failure to perform caused by circumstances outside its reasonable control, except to the extent liability cannot lawfully be excluded.
Such circumstances may include:
- changes in law or regulation;
- decisions by government authorities;
- import, export, transit, breed, entry or release decisions by any competent authority;
- border closures;
- customs delays;
- quarantine measures;
- airline cancellations or schedule changes;
- aircraft changes;
- embargoes;
- strikes;
- industrial action;
- war;
- armed conflict;
- civil unrest;
- terrorism;
- epidemics or pandemics;
- natural disasters;
- extreme weather;
- IT or government system failures;
- telecommunications failures;
- courier delays;
- veterinary or laboratory delays; and
- acts or omissions of third-party providers.
18.2 Petcircle shall be entitled to a reasonable extension of time where performance is delayed by such circumstances.
18.3 Any additional third-party costs or additional Services required as a result of such circumstances may be charged to the Client, provided that Petcircle informs the Client, where reasonably practicable, before incurring material additional costs.
18.4 Where the relevant circumstances prevent performance for a prolonged period or make performance impossible, the parties’ rights concerning cancellation, termination, payment and refunds shall be determined in accordance with the agreed Services and applicable law.
19. LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or prejudices any liability, remedy or consumer right which cannot lawfully be excluded, restricted or waived under applicable law, including any mandatory consumer protection legislation.
To the fullest extent permitted by applicable law:
- Petcircle shall not be liable for indirect, consequential, incidental, special or economic loss;
- Petcircle shall not be liable for lost profits, loss of business, loss of opportunity or reputational damage;
- Petcircle shall not be liable for costs arising from missed or changed flights, refusal to board, replacement travel, hotels, accommodation, boarding, quarantine, storage, transportation or other consequential arrangements resulting from circumstances outside Petcircle’s reasonable control;
- Petcircle shall not be liable for the acts, omissions or decisions of MOCCAE, where applicable, or any other government, veterinary, customs or border authority, airline, veterinarian, laboratory, courier or other independent third party, except to the extent liability arises from Petcircle’s own breach or cannot lawfully be excluded;
- Petcircle shall not be liable for any refusal, rejection or delay relating to a banned breed, restricted breed, mixed breed or suspected crossbreed where Petcircle has performed the agreed Services with reasonable professional care and skill;
- Petcircle shall not be liable for consequences attributable to the Client supplying inaccurate, incomplete or inconsistent breed information or failing to provide requested breed-related supporting evidence; and
- subject to the exclusions and mandatory rights stated in this Section, Petcircle’s total aggregate liability arising out of or in connection with a specific booking shall not exceed the Petcircle Service Fees actually paid by the Client for the specific Service giving rise to the claim, excluding government fees, taxes and third-party charges.
The above limitations shall not apply to fraud, wilful misconduct, gross negligence or any other liability that cannot lawfully be excluded or limited.
20. CLIENT INDEMNITY
20.1 To the fullest extent permitted by applicable law, the Client shall indemnify Petcircle, its directors, employees and representatives against reasonable losses, claims, fines, penalties, expenses and third-party liabilities arising from:
- inaccurate or misleading information supplied by the Client;
- inaccurate, incomplete or misleading breed or breed-composition information;
- fraudulent or altered documentation;
- failure to disclose relevant information;
- failure to provide requested breed-related supporting evidence;
- breach of these Terms;
- failure to comply with applicable regulations;
- unlawful ownership, import or export of an animal;
- injury or property damage caused by the Client’s animal; or
- instructions given by the Client that are unlawful or contrary to Petcircle’s advice.
20.2 Any amount claimed under this Section must be reasonably attributable to the relevant act, omission or breach and must not exceed what is legally recoverable.
20.3 This indemnity shall not apply to the extent that the relevant loss was caused by Petcircle’s own breach of contract, negligence, wilful misconduct or any other act or omission for which liability cannot lawfully be excluded.
21. RIGHT TO REFUSE, SUSPEND OR TERMINATE SERVICES
21.1 Petcircle may refuse, suspend or terminate Services where:
- invoices remain unpaid;
- requested documentation is not provided;
- information supplied appears inaccurate, fraudulent or misleading;
- the Pet’s breed or breed composition is not adequately disclosed;
- the Client refuses to provide requested breed-related supporting evidence;
- Petcircle reasonably believes the proposed movement may be unlawful;
- animal welfare may be compromised;
- the Client fails to follow regulatory instructions;
- the Client or another involved person behaves abusively or threateningly toward staff or third parties;
- continuing the Services may expose Petcircle to material legal, regulatory, compliance or safety risks; or
- Petcircle is required to do so by law or a competent authority.
21.2 Where reasonably practicable and appropriate in the circumstances, Petcircle will notify the Client of the relevant issue and provide an opportunity to resolve it before suspending or terminating the Services.
21.3 Termination does not affect Petcircle’s right to payment for work already performed or costs already incurred.
21.4 Any prepaid Petcircle Service Fees attributable to Services not yet performed shall be handled in accordance with Section 11 and any mandatory applicable law.
22. DATA AND CONFIDENTIALITY
22.1 Petcircle may collect, use, store, disclose and otherwise process personal data and pet-related information where reasonably necessary to provide the Services and for other lawful purposes described in Petcircle’s Privacy Policy, in accordance with applicable data protection law.
22.2 The Client acknowledges that, where necessary for the performance of the Services, personal data may be transferred to or accessed by competent authorities, veterinarians, laboratories, airlines, agents and other service providers located in countries outside the Client’s country of residence or outside the UAE, subject to applicable data protection requirements.
22.3 Petcircle will process personal information in accordance with applicable data protection legislation and Petcircle’s Privacy Policy, which forms part of the information provided to the Client regarding the processing of personal data.
22.4 Where the Client provides personal information concerning another individual, the Client confirms that they are legally entitled to provide that information for the purposes of the Services.
22.5 Petcircle will take reasonable measures to protect confidential Client information, subject to disclosures necessary to perform the Services, comply with legal obligations, exercise legal rights or respond to requests from competent authorities.
23. MULTILINGUAL SUPPORT AND TRANSLATIONS
23.1 Petcircle may communicate with Clients in several languages for convenience.
23.2 Unless expressly stated otherwise, translations and multilingual explanations are provided as support and do not constitute certified or sworn translations.
23.3 Official documents will be prepared or submitted in the language required by the relevant authority.
23.4 Where a certified or legally authenticated translation is required, additional third-party fees may apply.
24. LANGUAGE OF THESE TERMS
24.1 These Terms may be provided in Arabic, English and other languages.
24.2 Where UAE consumer protection law applies, Petcircle shall make consumer-facing contractual information available in Arabic as required by applicable law and may provide English or other language versions alongside it.
24.3 For transactions not subject to such mandatory language requirements, the English version shall prevail unless applicable law requires otherwise.
24.4 In the event of any inconsistency between language versions, any mandatory rule governing language or interpretation shall prevail.
25. INTELLECTUAL PROPERTY
25.1 All original materials created by Petcircle, including proprietary guides, checklists, internal processes, website content, branding and Petcircle-created templates, remain the intellectual property of Petcircle or its licensors.
Nothing in these Terms claims ownership of official government forms, regulatory certificates, Client documents or third-party materials.
25.2 Materials supplied to the Client may be used for the Client’s own purposes in connection with the relevant Pet journey, including submission to veterinarians, airlines, authorities and other parties involved in the agreed Services.
25.3 Petcircle’s proprietary materials may not be copied, commercially distributed, resold, published or used to provide competing services without Petcircle’s prior written consent, except as permitted by applicable law.
26. WEBSITE INFORMATION
26.1 Information published on the Petcircle website, social media channels, guides or other general materials is for general informational purposes only.
26.2 Pet travel requirements vary according to country, Pet, route, owner, date, breed and means of transportation.
26.3 General website information does not replace an individual assessment and should not be relied upon as confirmation that a particular Pet, including a banned, restricted or mixed-breed Pet, is eligible to travel, be exported from, imported into, transit through or enter any particular country.
26.4 Nothing in this Section excludes responsibility for information or representations where liability cannot lawfully be excluded.
27. CONSUMER RIGHTS AND DISTANCE CONTRACTS
27.1 Where the Client acts as a consumer, any mandatory consumer protection rights applicable to the contract and incapable of lawful exclusion remain unaffected.
This may include statutory cancellation or withdrawal rights applicable to distance or off-premises contracts in the European Union, European Economic Area, United Kingdom or other jurisdictions.
27.2 Where applicable, the Client may expressly request Petcircle to commence the Services before expiry of a statutory cancellation or withdrawal period.
Any legally required request or acknowledgement regarding commencement of the Services and the possible loss of a cancellation or withdrawal right must be provided separately and expressly by the Client.
27.3 If the Client validly cancels or withdraws after performance has commenced, Petcircle may charge such proportionate amount for Services already performed and such third-party costs as are permitted by applicable law.
27.4 Where the Services have been fully performed following the Client’s express request and legally required acknowledgement, any statutory cancellation or withdrawal right may cease to apply to the extent permitted by applicable law.
27.5 Nothing in these Terms excludes any mandatory right to a refund, repeat performance, compensation or other remedy arising from a failure by Petcircle to fulfil its contractual or statutory obligations.
28. COMPLAINTS
28.1 Any concern regarding the Services should be reported to Petcircle as soon as reasonably possible so that Petcircle has an opportunity to investigate and, where appropriate, correct the issue.
28.2 Complaints may be submitted by email to hello@petcirclellc.com.
28.3 Failure to notify Petcircle promptly may affect Petcircle’s practical ability to remedy an issue but does not remove any mandatory statutory consumer rights.
29. GOVERNING LAW AND JURISDICTION
29.1 These Terms and any agreement between Petcircle and the Client shall be governed by the laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai.
29.2 Subject to any mandatory consumer jurisdiction that cannot legally be excluded, the Courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Services.
29.3 Nothing in this clause is intended to deprive a consumer of mandatory rights or jurisdiction protections applicable under the laws of the consumer’s place of residence where those protections cannot legally be waived.
30. ENTIRE AGREEMENT AND PRIORITY
30.1 These Terms, together with the accepted quotation, invoice, booking confirmation and any expressly agreed special conditions, constitute the entire agreement between the parties, subject to any mandatory pre-contractual representations or other rights that cannot lawfully be excluded.
30.2 Where a specific written term in a quotation expressly conflicts with these Terms, the specific written term shall prevail for that booking, subject to applicable law.
30.3 No amendment to the agreement shall be effective unless it is expressly identified as a contractual amendment and confirmed in writing by an authorised representative of Petcircle.
30.4 Routine communications by WhatsApp, email or other messaging services shall not, by themselves, amend these Terms.
31. ASSIGNMENT
31.1 The Client may not transfer or assign their rights or obligations under the agreement without Petcircle’s prior written consent, except where applicable law provides otherwise.
31.2 Petcircle may engage subcontractors or third-party service providers where reasonably necessary to perform the Services.
31.3 Petcircle remains responsible for its own obligations under the agreement to the extent required by applicable law.
32. SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be limited or removed only to the extent necessary.
The remaining provisions shall continue in full force and effect.
33. NO WAIVER
Failure by Petcircle to enforce any right or provision on one occasion shall not constitute a waiver of that right or provision on any future occasion.
34. AMENDMENTS
34.1 Petcircle may update these Terms from time to time.
34.2 Unless required by law, amendments will apply to new bookings made after the revised Terms are published or otherwise made available to the Client.
34.3 Existing bookings will remain subject to the version of the Terms accepted when the booking was made unless otherwise agreed in writing or required by applicable law.
